Can a foreign company buy a house in Taiwan?
If the foreign company can prove that the citizens of Taiwan are allowed to register as the owner of property (houses or land) in such foreign company’s mother country, then the foreign company has the same rights in Taiwan.
However, there are the following points to note:
1.The foreign company must apply to Ministry of Economic Affairs, R.O.C.(Taiwan) for “recognition of foreign company and registration of branch office”.
2.The following types of land shall not be transferred or leased to foreigners (including foreign companies): Forest lands, Fisheries, Hunting grounds, salt fields, Lands with mineral deposit, Sources of water, Lands lying within fortified and military areas and lands adjacent to the national frontiers.
3.The purpose: self-use, investment, or public welfare.
4.The usages:Residences, Business place, office buildings, shops and factories, etc.
5.If the company purchase the house for residential use: a usage plan must be submitted, and approval from the Ministry of the Interior, R.O.C.(Taiwan) is required. Additionally, the house may not be transferred within 5 years of registration.
6.After all required documents for real estate ownership registration are complete, the Land Office will send the case to the competent Special Municipal or County (City) Government for approval.
